The German Whistleblower Protection Act (Hinweisgeberschutzgesetz) obliges employers to set up an internal reporting channel for information on legal violations. The transition period for implementing the obligation ends on 17 December 2023. As a result, small and medium-sized companies with 50 or more employees must also by this time have a corresponding reporting system in place. Failure to do so could result in severe fines.

The Labour law implications that employers should consider can be found here.

Furthermore, in our German employment newsletter “Arbeitsrecht Highlights“, we also highlight current developments regarding the recording of working hours and the termination of (agreed) home office contracts. We also present selected new case law (German edition only).
